THESE TERMS  AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME  TO TIME IN OUR SOLE DISCRETION. WE WILL NOTIFY YOU OF AMENDMENTS  TO THESE TERMS AND CONDITIONS BY POSTING THEM TO THIS WEBSITE AND  JENNTRAINING FITNESS, LLC PRIVATE TRAINING AND NUTRITION APP. IF YOU  DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT  ACCESS THIS WEBSITE OR JENNTRAINING FITNESS, LLC TRAINING AND  NUTRITINON APP.

 

Welcome to jenNtraining Fitness, LLC! We are excited to have you join us as you begin your  fitness journey. jenNtraining Fitness, LLC is aimed at helping you reach your fitness goals,  regardless of your exercise background. I am very proud of all the clients I train and have high  expectations. At the same time, I must stress that as a client you are ultimately responsible for your  own achievements. Therefore, when you join jenNtraining Fitness, LLC Programs the following  is required:

 

1. MAXIMUM EFFORT AND 100% COMMITMENT:

• There is no guarantee that these programs will make you lose weight or gain muscle, I can  only provide you with the exercises and nutritional advice to put you on the path to fitness.

• You can only get out of these programs, what you put in!

• The programs are focused on fitness and nutrition, therefore, there will be zero paid product  marketing or marketing of any kind, unless approved by Jennifer Gabriel.  

• There will be zero refunds issues – remember, results aren’t guaranteed; they are earned!

• All members must be 15 years of age or older in order to be a Member of jenNtraining Fitness, LLC.  

  • The Lifelong Fit Tribe is only for females due to privacy concerns. 

  • Well + Fit Boot Camp is only for females due to privacy concerns. 

  • The 1:1 Private Training in person, Hybrid Private Training, or Online Private  Training are is for women.

 

2. ENCOURAGEMENT:

• We are here for each other to help with accountability and self-confidence. For this reason, the following rules will apply for all jenNtraining Fitness programs:

  • No inappropriate behavior (i.e. bullying, harassing, rudeness, etc.).

  • No sharing other member’s photos or information without approval from that person.

  • Jennifer Gabriel has the sole ability to determine what is considered inappropriate behavior.

  • Inappropriate behavior will result in immediate removal from any of the programs offered with no refund.

 

3. MEMBERSHIP FOR LIFELONG FIT TRIBE RENEWAL AND REMOVAL:

• Each monthly session will be four weeks long.

  • Non-paid members or Members cancelling their membership will be removed from the program at the end of their four weeks by 10:00 a.m. CST.

• The month to month payment option will be removed as soon as participate limit for that month has been met or will be removed 48 hour prior to the new program starting.

• If a Member’s recurring plan fails, for any reason, the Member has twenty-four (24) hours from the cancellation notification email to re-sign up with a new payment method. If the Member fails to re-sign up within the twenty-four (24) hour period the Member’s access will be removed until the next available 4 week session begins.

 

4. HONESTY AND LEGAL:

• ONLY the payment Member is allowed to view the private training app.

  • Member shall not allow any non-paying member including their significant other or minor children to view the training app in any way.

• No sharing the workouts, meal plans, or recipes, under any circumstances, with anyone that is not a paying client of jenNtraining Fitness, LLC.

  • Any spouse or child participating in jenNtraining Fitness, LLC who is a paying  member with a paying Member is also bound by these Terms and Conditions and  shall be subject to the same requirements and restrictions as the paying Member.

  • Any spouse or child participating in jenNtraining Fitness, LLC who is a paying  member with a paying Member shall respect the privacy of the other jenNtraining  Fitness, LLC members to the same extent as required of the paying Member. 

  • All Members shall be responsible for any infractions or issues caused by the spouse  or child, including but not limited to, removal from jenNtraining Fitness, LLC  without a refund and legal proceedings.

• Members shall not copy, sell, share or in any way disseminate any of the materials received  from jenNtraining Fitness, LLC including but not limited to work out information, meal  plans and/or recipes without the express written consent of jenNtraining Fitness, LLC.  

• Members further agree that they shall not advertise or market other fitness groups’ products  or instructors within the group or to jenNtraining Fitness, LCC members without the prior  approval of jenNtraining Fitness, LLC.

• Member is responsible for reading and following both the Cancellation Policy and Return  Policy, both of which can be found on jenntrainingfitness.com.

 

5. SAFETY:

• It is recommended that all members acquire clearance from their personal physician before  beginning this exercise program. 

• By participating in jenNtraining Fitness, LLC, the member warrants and represents that  they have no disability, impairment, or ailment preventing member from engaging in active  or passive exercise, or that will be detrimental or adverse to such member’s health, safety,  or physical condition if member does so engage or participate.  

• It is the member’s responsibility to notify Jennifer Gabriel of any medical conditions or  recurring injuries that she should be made aware of. 

• Member recognizes that there are hazards and risks connected with physical fitness training. Member agrees to defend, indemnify, and hold harmless jenNtraining Fitness, LLC and Jennifer Gabriel against any loss, damage, or expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising as a result of, or in connection with, participating jenNtraining Fitness, LLC.

 

By joining jenNtraining Fitness, LLC, member is agreeing to be legally bound by the terms and conditions contained herein. Again, welcome to jenNtraining Fitness, LLC!

 

WAIVER

 

By use of the website, membership and/or participating in an individual training session of jenNtraining Fitness, LLC, hereinafter “company”, and by the execution of the agreement the member expressly agrees that the company shall not be liable for any damages arising from personal injuries sustained by the member or his or her guest or anyone using said membership with the consent of the member. The member assumes full responsibility for any such injuries or damages that may occur to the member as a result of said membership, utilization of the website and/or individual training sessions and further agree that the company shall not be liable for any loss. The member also specifically agrees that the company should not be responsible for injuries, damages, loss, or theft even in the event of negligence by the company whether such negligence is present at the signing of this agreement or accessing the website or takes place in the future. This waiver does not apply to intentional torts by the company.”

 

“Furthermore, jenNtraining Fitness, LLC shall not be liable for any loss, damages, injuries or other casualties of whatever kind or by whomever caused to the property or person and specifically for any damages arising from personal injuries sustained by member occasioned by any cause whatsoever including any claim that the premises of jenNtraining Fitness, LLC has not been kept in repair or any other acts of negligence by jenNtraining Fitness, LLC, its members, managers and/or employees, while in or upon the premises or any part of the premises during the term of this agreement.
